Divorce Process
In Texas, one party initiates divorce proceedings by filing an "Original Petition for Divorce." Once the petition has been filed, there is a 60 day waiting period before the divorce can be made final. If the divorce is uncontested, which means the spouses can agree on all of the terms of the divorce, it can be finalized more quickly. If, however, the parties cannot agree on all or some of the terms, such as child custody, spousal maintenance, and division of property, the case will often proceed through litigation, which can be costly and time-consuming. Collaborative Divorce
Collaborative divorce is a process that enables the parties, with assistance of legal counsel, to come to their own agreement without undergoing the time and expense of litigation. Typically, collaborative divorce is less traumatic for all participants involved, especially the children, and it focuses on the spouses instead of the attorneys and court. It can also be less costly.
Mediation
Mediation is a less formal process that allows the parties to avoid court. Everyone sits together and amicably works out the divorce arrangement. This process, like collaborative divorces, proceeds more quickly, less expensively, and more privately than a traditional divorce trial.
